Because of the complexity of his case, John Coltharp’s attorney has asked for another postponement of his preliminary hearing. Stating it would be a disservice to both the defense and the prosecution, Coltharp’s attorney, Paul Frischknecht, asked Judge Wallace Lee to once again move the preliminary hearing out about four weeks. Acting Sanpete County Attorney, Kevin Daniels, agreed that because of the volume of information, the number of potential witnesses, and the seriousness of the charges, the longer time before the hearing is warranted. He also stated the FBI has been sent some evidence for processing, and hopefully it will be back by that time. Coltharp remains in the Sanpete County Jail on $50,000 cash only bail with an additional $100,000 cash only bail in Utah County. He has two pending cases in Sanpete: a first degree felony kidnapping and class A misdemeanor charge of obstruction of justice, as well as a first degree sodomy of a child charge. Daniels indicated that more charges may be filed, but they will be added to the existing charges. A preliminary hearing for both cases is scheduled for February 20 at 9:30 a.m.
