The man accused of kidnapping and raping a Snow College student in December 2021 appeared before Judge Marvin Bagley on Wednesday, June 7 as his attorney asked to vacate his trial date in August. Brent Brown has been in jail since he was arrested on the charges, and according to his attorney, Michael Labrum, the defense is still waiting for all the discovery in the case, due in part to a change in the Wayne County prosecutor on the case. He also stated his client has not had a detention hearing to determine if Brown can be released from jail as he awaits his trial. He said Brown’s release would be helpful as they prepare for his defense. However, Sanpete County Attorney Kevin Daniels said he would strongly argue against release at that hearing. Judge Bagley did vacate the August trial date, setting a detention and pretrial hearing for August 21, and he said all discovery must be submitted by that date. A new trial date has been set for January 2024.
