Utah Supreme Court Overrules Lower Court On Sexual Assault Care

(Salt Lake City, UT) — The Utah Supreme Court is giving new life to a sexual assault lawsuit that was dismissed by a lower court. The high court ruled yesterday the 2022 case against former Provo obstetrician-gynecologist Dr. David Broadbent may resume. The ruling allows 94 women the chance to pursue their claims outside the framework of medical malpractice. The women claim Broadbent sexually assaulted them during medical treatment. Broadbent’s attorneys had argued the allegations in the civil lawsuit were actually a medical malpractice action and the lower court had agreed.
