Utah Supreme Court Hears Arguments In Case Involving Cellphone Passcodes

(Salt Lake City, UT) — The Utah Supreme Court is being asked to decide whether suspects in criminal cases can be forced to give investigators their cellphone passcodes. Justices heard arguments in the case yesterday after a lower court decision was appealed by the Attorney General’s Office. Prosecutors had argued in court that the suspect in an assault and kidnapping case must be guilty because he refused to let investigators unlock his phone. The lower court said the suspect could not be forced to give up his passcode because it was protected by the Constitution’s Fifth Amendment.
