State Supreme Court Upholds Ruling on Paule Conviction

(Salt Lake City, UT) – The Utah Supreme Court says it is possible to be found not guilty of murder but be guilty of other crimes in the same case. The state’s high court in early February upheld a ruling by the state’s Court of Appeals in a case involving Elbert John Paule. Paule was found not guilty of murder by a Utah County jury, but the same jury found him guilty of obstructing justice in the second degree. Paule appealed the verdict, claiming the conviction was inconsistent with the not guilty of murder verdict. The lower court affirmed the conviction verdict on appeal.
