Judge keeps alive newspaper case seeking BYU police emails

SALT LAKE CITY (AP) — A judge is keeping alive a newspaper open-records lawsuit aimed at obtaining Brigham Young University police emails for a probe of allegations that sex assault victims who made honor code complaints were improperly investigated.
A university spokeswoman didn’t immediately comment Monday about 3rd District Judge Laura Scott’s ruling on Friday denying a BYU request to dismiss the case brought by the Salt Lake Tribune.
The Tribune reports (http://bit.ly/2jUSBnP ) it wants to review emails between BYU police and the university’s honor code and Title IX offices.
BYU argues that because it’s privately owned by the Mormon church, campus police aren’t subject to state open records law.
The Tribune argues that BYU police records are public, are just like records for any other law enforcement agency in the state.
