Top EPA Administrator deregulates coal

Published on December 23, 2008 at 07:39AM

(WASHINGTON D.C.) – The nation’s top environmental administrator says there’s no reason to regulate the greenhouse gas emissions of coal-fired power plants. EPA Administrator, Steven Johnson, issued a memo stating that with the regulations, more than 20 different industrial sectors, along with offices, schools, apartments and hospitals, might be subject to “costly and inflexible permitting requirements.” Green groups say the administrator has dropped a “lump of dirty coal” in American’s Christmas stockings with the memo and an attempt in a last-minute effort to influence policy before the Obama administration takes office. The ruling could have an effect on two other proposed coal-fired power plants up for review in Utah including, a 270-megawatt plant near Sigurd and a 900-megawatt Unit Three at IPP in Delta. In 2007, the U.S. Supreme Court cleared the way for regulating greenhouse gases under the clean-air law.

Snowy conditions close schools

Published on December 17, 2008 at 08:08AM

(ST. GEORGE) – An elementary school north of St. George closed Tuesday due to snowy conditions. A road report said that students at Diamond Valley Elementary were not allowed to go to school because conditions were too treacherous on S-R 18. Another report said that middle and high school students were also asked to stay home in the community about 15 miles north of St. George. Weathermen reported the closures were rare during the second day of an unusual winter blast that has hit Washington County, which attracts large numbers of snowbirds each winter to enjoy normally mild weather and sunny days. Students in other communities along the highway, including Gunlock and Veyo, were bussed to St. George for classes, but experienced two-hour delays. Washington County School District Human Resources Director, Lyle Cox, said the closures and delays impacted between 350 to 400 of the district’s 24,000 students. Cox said he expects operations of the district’s 100 buses to return to normal today (Wednesday).

Water rights bill up before Legislature

Published on December 17, 2008 at 07:42AM

(SALT LAKE CITY) – The Utah State Legislature is considering a new bill in the next session that would end hostile water-law debates. The bill’s sponsor, Rep. Ben Ferry of Corinne, says the law would add a bit of paper to every real-estate transaction spelling out exactly whether any water right accompanies the sale and if so, what it is. Department of Natural Resources chief, Mike Styler, says the legislation would clear up the tangled confusion of water-rights owners and bring a 19th-century water law into the 21st-century. As envisioned, the water-rights transfer or acknowledgement of no transfer or sale would be part of the deed of sale. County Recorders would store the record and inform the Utah Division of Water Rights and state engineer of the particulars. Currently, there’s no requirement to tell the state when water rights shift as in home or auto sales. Problems are brought to light only when water owners attempt to use the water and have no authority to do so. A state task force consisting of water lawyers, state officials and representatives of water agencies met 11 times between April and October on matters concerning water-rights disputes.

Trainer helps reduce holiday stress

Published on December 16, 2008 at 10:35AM

(RICHFIELD) – Several popular presentations and seminars are being held around the country to address stress in the home, workplace and individual lives. Master Trainer, Jeri Mae Rowley of MS Human Resource Management, says stress studies have been conducted for over 60 years but it’s only been since 1995 that women have been included in those studies. Rowley says men and women have different levels of stress in dealing with similar situations. She said that women, in particular, have special needs like discussions, hugs and personal time. Rowley commented that back in the 1950’s, a Canadian scientist conducted studies on the comparison of stress on physical structures and humans and came up with the conclusion that stress wears people out just like buildings and bridges. She also noted that “STRESSED” spelled backwards, says “DESSERTS”. For over 15 years, Rowley has taught college business management, marketing, travel and human resource management courses and delivered hundreds of presentations at seminars.

HARRISONBURG, Va. (AP)—Andrew Swink had an interception and a key breakup on 4th and 20 to repel James Madison for the last time and the Montana Grizzlies advanced to the FCS (I-AA) championship game with a 35-27 victory Friday at Bridgeport Stadium. After Dave Stannard put the Dukes on the board first with a 32-yard field goal, the Grizzlies used two Chase Reynolds touchdown runs to take a 14-3 lead heading into the second quarter. Although James Madison pulled to within 14-10 at halftime on a Eugene Holloman touchdown run, they were dealt a serious blow as star quarterback Rodney Landers sustained a leg injury. Meanwhile, the Grizzlies forced a pair of turnovers in the third quarter and quarterback Cole Bergquist tossed for three scores in the period to give Montana a supposedly insurmountable 35-17 lead. However, James Madison caught fire as reserve signal-caller Drew Dudzik made numerous big plays to keep the Dukes close. After a Montana punt sailed out of the end zone for a safety, Dudzik’s 18-yard touchdown run pulled James Madison to within eight at 35-27. However, the Grizzlies made one last stand and will now play the winner of Northern Iowa and Richmond in tomorrow’s semifinal at Cedar Falls, Iowa. Click here for game summary

Utah Agrigulture Strategic Plan

Published on December 12, 2008 at 01:02PM

(Utah) The Utah Department of Agriculture has updated their Strategic Plan. One of the main goals of the plan is to educate the public about issues facing the agriculture industry. According to State Ag Commissioner Leonard Blackham, the department spent a year taking input from different groups before putting to plan together. A recent survey found that ninety percent of respondents from the Wasatch Front favored maintaining agriculture in Utah. But a number of ideas are being considered in the nation and in the state that would place unsustainable burdens on the industry, including taxing producers for emissions from cattle. Commissioner Blackham says that they hope to put some of those ideas to rest with proper education about their consequences.

Keeping Jobs In Six County Area

Published on December 12, 2008 at 12:17PM

(Manti) The six county area of Utah is taking its share of hits with the slowing economy, but not as much as might be expected. The most notable trend in the past few quarters has been the amount of turnover in the labor market. The area averaged 4,500 new hires and 3,500 separations during four quarters ending with the third quarter of 2007. According to the Department of Workforce Services, new data also shows that younger workers make up a large percentage of those shifting jobs. At the same time, workers under twenty-five years of age make up only about twenty percent of the total workforce.

Sanpete woman gets plea deal in baby death

Published on December 12, 2008 at 11:33AM

(MANTI) – A week-long jury trial for a Sanpete woman charged with recklessly causing the death of her 21-day old daughter in 2005, has concluded with a plea agreement. Court records say that 23-year old, Carmen Papenfuss, a former resident of Ft. Green, allegedly beat her daughter, Selah, to death on the night of Dec. 15, 2005. During the trial, autopsy reports showed the baby had bruises on her body and bleeding on the brain, indicating a beating. Sixth District Court Judge, David Mower, presided over the proceedings and attorneys reached an agreement that the case would be diverted for a year and then dismissed with prejudice, if Papenfuss obeys all local, state and federal laws. After the year is concluded, Papenfuss would not be subject to a jury trial and the case would be closed. Court clerks said the reason for the plea agreement is due to a witness for the defense giving more information than what the county attorneys had and wanted the judge to declare a mistrial. Attorneys in trials are supposed to receive all information necessary for both the defense and prosecution to use. Papenfuss’s attorney will file an order on the plea agreement and the judge will sign it.

Judge dismisses portion of deputy lawsuit

Published on December 12, 2008 at 07:29AM

(RICHFIELD) – A federal judge has dismissed part of a lawsuit filed against Sevier County Sheriff, Phil Barney, by some of his employees. In an order filed in U.S. District Court last month, Judge Bruce Jenkins dropped claims filed by deputies Kirt Rippsten and Jack Peterson against the sheriff, saying that since they reported directly to Barney, he had every right to relieve them of their duties. Rippsten was the jail commander and Peterson was the director of the county’s emergency services who claimed Barney removed them from their positions because they supported Barney’s opponent in the 2006 election. A report stated that Rippsten and Peterson are among five deputies who sued Barney for retaliation against them. The judge has yet to rule on the three remaining deputies who sued Barney. Allen Pearson, Jerred LeFevre and Troy Morgan accuse Barney of demoting them and slashing their pay after being “displeased” with their support of his opponent, Delbert Lloyd. Lloyd was Barney’s former chief deputy, who claims he was relieved of duty when he told the sheriff he was running for office. Sheriff Barney was re-elected in 2006.

In the second half, the Saints scored 17 unanswered points and took a 24-21 lead when Brees hit Marques Colston on an 11-yard scoring play late in the fourth quarter. Nevertheless, the dormant Chicago offense suddenly came to life and after a 60-yard drive in the closing moments tied the game with Gould’s first field goal, from 28 yards. After winning the coin toss in overtime, the Bears capitalized on a 39-yard pass interference penalty to drive into range for Gould’s game-winner. Pesticide kills dog on melon farm

Published on December 05, 2008 at 08:07AM

(GREEN RIVER) – A Green River man has been sentenced for misusing a pesticide that killed a hound dog on his melon farm. A newspaper report stated that 51-year old, Chris Dunham, pled guilty in U.S. District Court in Salt Lake City Wednesday for using a registered pesticide in a manner inconsistent with its labeling, a misdemeanor charge. According to the guilty plea, Dunham placed 50 bowls of cat food soaked with Furadan around his melon farm to keep out pests. Prosecutors said that after setting out the bowls, Dunham invited a man and his blue-tick coon hound dog to hunt a bear that Dunham wanted removed. Apparently, the dog sniffed out the cat food, ate it and died shortly afterward. The victim sued Dunham for loss of his bear-hunting dog and the judge sentenced Dunham to a year’s probation and ordered him to pay $7,500 in fines and restitution. U.S. Attorney for Utah, Brett Tolman, defended the sentence saying that Dunham is a licensed pesticide applicator who knew that using Furadan for bait is both illegal and dangerous.

(MOAB) – The Grand County Council has denied a draft letter to be sent to the BLM concerning oil and gas leases in the county. The Council organized a committee to review leasing on county land and at this month’s Council meeting, members reviewed several drafts of the letter and determined that there was too much confusion on the issue. The Council ended up not taking sides on the issue and is waiting for the BLM to make their determination. A public hearing was also held during the council meeting concerning input on a proposed Scenic Byways Corridor Management Plan for State Highways 128, 279 and 313. One resident asked the Council to ban trucking along Highway 128, the most traveled of the three but several citizens voiced concern over the ban because the road is used for transporting uranium and other economic uses. The Council also wanted to introduce language in the plan that would not stop campground growth along the highway. The Council also wants to educate the public to use bicycle paths along State Highway 128, not the road.
