(GUNNISON) – A Richfield truck driver cited for rolling an oil tanker on SR-28 north of Gunnison on Oct. 6, has been cleared by a court. Michael Patey was driving a 2000 Peterbilt tanker truck when he pulled to the right of the highway to allow another vehicle to pass him. The pup on the back of his trailer hit the gravel, broke loose and rolled over on its side. UHP Trooper, Lance DeGraw, cited Patey for unsafe lane travel but Patey pled his case before the Sanpete County Justice Court, saying the other vehicle cut him off, causing him to pull too far over to avoid killing them both. The court agreed and dismissed the violation. Patey was fired from the trucking company because of the accident and is now working for another company. He claimed he had a perfect driving record with the company he was working for.
