A judge has declared a mistrial in a case brought by dairy farmers against a power plant that was wrapping up in a rural Utah courtroom. The Millard County farmers claimed that stray electricity from the Intermountain Power Plant near Delta was making dairy cows sick. A court official confirmed that the trial was aborted on Monday in the sixth and final week of the trial. The plaintiff’s lawyer, Jefferson Gross, says the mistrial was called after a juror reported Monday that she heard an allegation outside court that the power plant would shut down and lay workers off if the farmers won. Gross says the power plant has insurance to cover a judgment. He says the claim made by a general manager of the power plant at an employee meeting was ludicrous.
