Judge sets court date on gas leak lawsuits

(GUNNISON) – A string of lawsuits filed by Gunnison residents and businesses against Top Stop went to court on Monday. A judge ordered all eleven lawsuits to be consolidated into one case against Wind River Petroleum, the parent company who owns Top Stop Convenience Stores. Several Gunnison homeowners and businesses are suing Wind River for monetary damages resulting from the leak of 20,000 gallons of gasoline last year at Top Stop that spread underground and traveled more than three blocks. Homeowners, Jeremy and Marlo Taylor, have a home at 255 South 100 West and Marlo says she feels they’ve been hit the hardest. Taylor said she’s still living with her in-laws and can’t afford to rent and is disappointed that the judge set the next court date in March of 2009. Gunnison officials said the town’s business district has been impacted, including several stores that have had to close because of fumes from the gas leak. Wind River Petroleum claims the remediation efforts are showing positive progress.
